Term and conditions

All deliveries and services (written en oral) are subject to the conditions set out below.

Unless expressly agreed otherwise, all our invoices are payable no later than thirty days after the invoice date. If the amount due has not been settled on its due date, a default interest of 1.25% per month on the unpaid invoice amount will accrue by operation of law and without the need for a registered notice of default. Each month started will be counted as a full month. In the event of non-payment on the due date, the invoice amount will be owed by operation of law and without prior notice of default, amounting to 10% of the invoice amount still owed, with a minimum of € 75.00 €. In the event of non-payment of the invoice amount on the due date, all other outstanding claims on the customer will become due and payable by operation of law and without prior notice of default. If an invoice remains fully or partially unpaid on the due date, eFFkes BVBA has the right to suspend further deliveries, until the amount due, including the interest and increase clause, has been paid in full and without prior notice of default and without compensation.

In the event of non-payment or only partial payment of the invoices, all user rights will exclusively rest with eFFkes BVBA and this until the moment of full payment.

In the event of premature cancellation of an order by the customer, the costs performed up to that time will be charged, with a minimum of 50% percent of the cost price of the total offer.
Tenders are always subject to unforeseen circumstances.

Recorded images are edited or edited at the discretion of the supplier, taking into account any wishes of the client. It remains a subjective product, which means that the client can never claim as the reason for non-payment of the invoice that the end product is not completely to his liking.
All complaints regarding delivered works must be notified to eFFkes by registered letter within eight calendar days after the invoice date, on pain of forfeiture. After the expiry of the eight calendar day period, the invoices are considered to be accepted without reservation.
eFFkes can never be held liable for any form of trading loss, consequential loss or loss of turnover of the client.

eFFkes cannot be held liable and therefore cannot be held to pay any compensation if an assignment cannot be carried out or is insufficient for technical reasons, such as power failure, damage to video tapes, adverse weather conditions, equipment failure, etc. or due to traffic problems. (traffic accident, traffic jam, diversions,…).

The expected duration for an assignment or the delivery date communicated by eFFkes is purely indicative and can in no way be considered binding. Any delay does not entitle the customer to cancel the order or claim any form of compensation.

The application of the regulation on value added tax (VAT) will be done according to the indications of the customer and under his full responsibility.

The obligations towards SABAM are fully responsible by the customer. eFFkes cannot be held liable in any way if the customer fails to fulfill his obligations towards SABAM.

All eFFkes productions are subject to copyright law. eFFkes has an inalienable moral right to all and full production. The multiplication of productions in any way, in whole or in part, without the permission of eFFkes, is therefore prohibited and even punishable.

The customer who gives a reproduction order, in full, in part and reworked by assembly, is assumed to be entitled to do so. eFFkes cannot be held liable in any way if the customer does not have the necessary rights.

eFFkes reserves the right to use the materials for promotion.

Delivered goods are neither taken back nor exchanged.

Subject to prior agreement, eFFkes will keep recordings made for ten days after delivery of the end product. The basic recordings made remain the property of eFFkes.

All agreements to which these general terms and conditions apply, as well as all other agreements arising from them, are exclusively governed by Belgian law. The courts of East Flanders are exclusively competent for any disputes regarding the agreement, invoice, general conditions,…
